These contractual Terms & Conditions are intended to establish the terms and conditions governing the provision of travel services organised by The Tripidea (Inversiones Salud y Bienestar SAS), hereinafter referred to as the Agency, headquartered in Medellín, Colombia, in Calle 30c #, 70-34, registered with the Tax Identification Number 900824543-9 and with the National Tourism Registry No. 147466, between the Agency and the Client.
This document is governed by the rules described in Law 2068 of December 31, 2020, which regulates the proper functioning of companies providing tourist services in Colombia. The terms below regulate the relations between the Agency and its clients in the national territory.
When contracting with the Agency, the Client acknowledges and accepts all the terms and conditions established herein.
Upon registration, the Client must book the trip with 50% of the total amount of the package, and the remaining amount must be paid within 60 days before the start of the trip - in this case, the date of arrival in Colombia. For special campaigns there may be particular T&Cs which will be described in the Travel Program for the campaign in question.
If the Client registers 30 days or less before the departure date, the person will have to deposit the cost of the entire trip. Always depending on availability.
For the validity of the registration, the Client must send to the Agency, via email, the proof/contract/policy of the international travel insurance contracted by the Client, which must be sent up to 60 days before the start of the trip.
A trip is unavailable when there are no more places available in the group of travellers, for this purpose, the designation “Sold out” will appear publicly on social networks and/or on the website. For the Agency the minimum number of participants for the trip is five (5) people and the maximum number of participants is 15 people.Registrations are subject to the obtaining from the suppliers and confirmation of reservations for the requested services. If this confirmation is not obtained, the amount already paid by the Clients will be returned in full.
If the Client does not make the payment in accordance with the established conditions, or send the proof/contract/policy of the international travel insurance, the Agency is entitled to cancel this registration. In this case, the Agency will charge 30% of the package value.
With the act of registration, it is assumed that the Client is aware of and accepted the conditions on this page, as well as the particular conditions associated with the travel program. In addition, the Client declares that he/she is in adequate health conditions for the respective trip.
Upon the reception of the 50% of the value of the trip booked by the Customer - subject to availability - the Agency reserves the spot on the intended trip. An agreement is made between the Client and the Agency, only after confirming the reservation and communicating it in writing (email or otherwise).
When validating the reservation, the Client allows the Agency, on his/her behalf, to contact the entities supplying goods and services responsible for carrying out the trip. The provision of the same is the responsibility of the Agency or its subcontractors, namely travel agencies, accommodation, carriers and others, in accordance with the agreements entered into.
Colombia can be classified as a country with structures, organisation, culture and mentality that are very different from European daily life. Therefore, trips may have unforeseen circumstances, risks and different service levels, and the Client must be aware of this fact. At any time, the Client may send his/her questions to the email geral@thetripidea.com.
Prices shown in travel programs are based on exchange rates and service costs in effect at the time the program was created and may therefore be subject to changes that may arise due to variations in taxes, transport costs or fuel, exchange ratefluctuations, scheduled rates and any other service changes that are part of the program.
In the event of any change to the previously stipulated price, the Client will receive information on the new price and payment terms, within a maximum period of 15 days from the date of occurrence. The Client must send the response (acceptance or rejection) to such notification within a maximum period of 7 days. If the Client accepts the price change, the Agency will issue a new invoice for this adjustment. If the Client rejects said change, and therefore wishes to cancel the contractual relationship, he/she will have the right to do so and the Agency will charge 30% of the total value of the package. Every response must be made through the same means in which the notification was received from the Agency, if there is no response from the client, within the established period, the Agency will take this silence as the Client accepting the change as well as the payment deadlines, and will proceed with the issue of the new invoice.
The Agency reserves the right to change the Client's reservation in accordance with operational requirements or circumstances beyond its control.
The Agency may change the departure times, the order of the routes, or even replace any of the experiences presented in the program with another of the same category, whenever justified, and must always inform the Client in writing, as soon as possible, of any change if it occurs before the start of the trip; if it occurs during the trip, the Client will be informed, as soon as possible, in a personal way by the leader of the trip and in any case, an experience will be proposed as an alternative to the change. Scheduled visits may be subject to possible changes or restrictions due to organisational and/or gubernamental reasons. The Agency respects the rules in force imposed by the Authorities.
If, for any reason beyond the Agency’s control, any of the experiences and/or visits have to be suspended, and there is no replacement experience/visit, Clients will not be refund of the amounts paid for that particular experience.
The Agency may change the Client's reservation for reasons of force majeure, such as political instability, war or threat of war, riots, civil conflicts, border closures, terrorism, disaster of any kind, fire, epidemic or health risk, abnormal weather conditions or other similar events beyond the Agency's control and provided that this situation occurs by national or international directive through state or governmental entities. In this case, the Agency will reimburse any amounts paid for the services provided, in accordance with the legislation in force at the time of the event, excluding expenses incurred by the Agency in relation to the Client's reservation and services provided by third parties, in which case account 30% of the total amount of the package.
If, after confirming the reservation, the Client wishes to change his registration to an alternative date, he/she may do so subject to availability and as long as this date is public on social networks and/or website. The Client is responsible for paying the difference in amount between the dates, if any, upon acceptance of the change; as well as all expenses and charges that the situation entails. If the change is made 30 days or less before the start of the trip on which the Client is enrolled and/or if the suppliers do not accept the change, this change will be treated by the Agency as a cancellation by the Client.
The Client is aware that any change in the contracted services, requested by the Client during the trip, may imply a change in prices. Therefore, the prices will not correspond to the prices communicated by the Agency that motivated the hiring. The Client is responsible for paying all expenses and charges that the situation entails with the different contracted suppliers.
If the Client wishes, he/she may transfer the registration to another person as long as this person fulfils all the conditions and requirements for the trip. The communication of the transfer of the contractual position must be sent to the Agency up to 45 days before the start of the trip in writing and must have confirmation by the Agency.
The Agency is responsible for proceeding with the transfer of the registration, considering whether or not it is possible under the applicable air transport regulations. In the case of airline tickets, the name change refers to the conditions of the airline itself. The Client is responsible for paying all expenses and charges that the situation entails with the different contracted suppliers.
The Agency reserves the right to cancel the organised trip in case the number of participants does not reach the minimum previously stipulated and informed to the Client. In case of cancellation, the Client will be informed within 30 days before the start of the trip.
The Agency reserves the right to cancel the organised trip in cases that concern only the Agency, notice from the Agency will be given within a maximum period of 30 days before the start of the same, unless the reasons for the cancellation are out of its control.
The Agency may cancel the Client's reservation for reasons of force majeure, such as political instability, war or threat of war, riots, civil conflicts, border closures, terrorism, disaster of any kind, fire, epidemic or health risk, abnormal weather conditions or other similar events beyond the Agency's control and provided that this situation occurs by national or international directive through state or governmental entities.
In all these cases, the Agency will reimburse any amounts paid for the services provided, in accordance with the legislation in force at the time of the event, excluding expenses incurred by the Agency in relation to the Customer's reservation and services provided by third parties, in which case account 30% of the total amount of the package.
The Client must notify the Agency of the cancellation of the trip as soon as possible in writing (e-mail). Whenever there are cancellations by the Client, it will be the Client's responsibility to pay the expenses incurred by the Agency in relation to the Client's reservation, in this case 30% of the package value.
In the case of electronic and/or distance sales, the Client may exercise his/her Right of Repentance within five (5) working days from the date of booking the Agency's services and if the occurrence is 30 working days from the start of the trip. The Agency is obliged to reimburse the Client the entire amount paid to date within a period not exceeding 30 days.
The Agency will apply the following cancellation policies depending on the Client's case:
If the reason for cancellation is within the terms of any insurance policy the Client has, then such fees may, subject to the terms of the insurance policy, be returned to the Client by the insurance company contracted by the Client.
All information on the website, social networks and/or documents of the Agency about the travel program is correct, however, the Agency cannot guarantee that any item mentioned will be available, especially if it is provided by third parties and the Agency has no control over the same, it is the Agency's commitment to provide the Client with the best travel experience, relying on the Agency's discretion in its selection of the leader accompanying the group, the chosen itinerary, accommodation/hotels, transport, services, tours and guides hired at the place.
At the time the Client makes his/her reservation, it is assumed that the Client is in full health condition so that he/she can travel and that his/her health will not in any way impair the proper functioning of the trip, as well as the safety and the comfort of the other members of the group.
Therefore, the Client's common sense and honesty in communicating with the Agency are called upon, if they are not in a healthy condition to be part of an organised trip.
Requests related to special meals, additional health care or specific transport needs must be requested when filling out the reservation form, in the space reserved for that, by the Client. However, the Agency does not guarantee the possibility of them, nor assumes any responsibility or obligation, if the requirements of these requests are not fulfilled, or if the contracted partners or services cannot guarantee them.
No amount will be refunded if, in question, there are reasons beyond the Agency's control, such as transport delays, closures without prior notice, weather conditions or other cases beyond its control, which make it impossible to carry out the travel program correctly.
The stay during the trip will be made in hotels, and local accommodations when possible, which offer all the necessary basic amenities and are located in areas where the use of the sites is greater and better.
For solo travellers or with friends, accommodation will be in twin rooms (with two separate beds) or triple rooms (when this petition is previously requested). Solo travellers will share a room with other Agency clients. For couple travellers, the rooms will be a double room with a double bed. All rooms have a private bathroom.
Meals are on a half-pension basis, which includes breakfast and another meal during the day. This means that all breakfasts and lunches are included in the package price, as they will all be in group. The only lunches that are not included are those on the day of arrival and departure from Bogotá to/from Europe.
The Agency advises the Client to carefully read the programs of the trips proposed, and to take into account the items that are included or not, in the indicated value.
The Agency will not reimburse meals, experiences, etc., which the Client has chosen not to enjoy or when the spaces to be visited are closed for reasons beyond the Agency's control.
The nights booked in the accommodation are counted from the first day of travel - the date of arrival in Colombia - until the last day.
The Client is responsible for any costs incurred as a result of damages or extra cleaning fees, related to the accommodation. The Agency recommends the immediate notice of any pre-existing damage in the room to the staff of the accommodation in question and to the leader who accompanies the group.
When the Client occupies a seat in a carriage equipped with a seat belt, the service providers or cooperating operators, agents or organisations shall not be liable for any illness, injury or death, nor any loss, damage or claims resulting from any accident or incident, if the seat belt was not worn at the time of the accident.
The arrival and departure times, which appear in the travel programs and/or tickets, are in Colombian local time and in accordance with the timetables of the transport companies on the date the program was printed. Therefore, they are subject to change. On trips that include transport by bus/private vans/transfer service, the times indicated are approximate.
The Agency is not responsible for any delay or even lack of appearance at the places and times previously indicated by the carriers. All possible expenses for transport delays are borne by the Client.
The Client's luggage is restricted to a reasonable size and a maximum weight of 20 kilos (with rare exceptions that will be informed by the Agency), to which is added a small backpack/bag that can be taken with the Client in transport. The Agencyreserves the right to refuse oversized luggage in its experiences. If the Client decides to keep luggage different from that established by the Agency, he/she must be responsible for the costs associated with its transport.
On trips that include flights, as an integral part of the itinerary, it is the Client's responsibility to ensure that their luggage does not exceed the size and weight limits imposed by the airlines. The Agency is not responsible for any costs incurred for excessive and/or oversized baggage.
The Client is responsible for carrying his/her luggage for transport and to the room. There may be situations in which the Client will have to transport their luggage over long distances and through places with some obstacles, so there will be no assistance, unless the cost of this is borne by the Client and there is the possibility of such assistance.
The Customer is responsible for the luggage. The latter has the obligation to formally complain, if the luggage is damaged, has been stolen, lost or otherwise, with the service providers at the time of the occurrence.
The Client is responsible for all costs and travel plans to and from the start and end point of the trip, and there will be no responsible or Agency leader accompanying the Client from the country of origin.
The starting and ending point of the trip is understood to be the international airport of the first city on the itinerary, explicitly indicated in the Travel Program.
There may be times when the leader of the Agency accompanying the trip has to make decisions for the general interest of the group. The Client agrees to comply with the leader's authority and decisions, as well as the laws of the place to which he/she chooses to travel. If the Client does not comply or if, in the opinion of theleader, the Client's presence is not compatible with the general enjoyment and well-being of the other members of the group or the good functioning of the experience itself, the Agency reserves the right not to allow the Client to remain in the same. Possession or transport of illegal or restricted substances is strictly prohibited. Furthermore, the Client agrees that the rest of the group, as well as any leader of the Agency, has the right to be in a safe and comfortable environment. Any threats to the safety, well-being or inappropriate behaviour on the Clients part, whether verbal or physical, will be taken very seriously and may result in the immediate cancellation of the Clients trip. In this case, the Client is responsible for his/her own repatriation and related costs, having no claims against the Agency.
The Client agrees that the leader of the Agency accompanying the trip takes photographs and film him/her during the experience, and that the leader has access to his/her published images, videos or sound files, and that these contents are used by the Agency's team for the purposes of dissemination in its communication channels, without issuing a special authorization and without this use obliging the Agency to make any payment. If the Client wants to revoke this point, he must communicate his will to the Agency or Travel Leader, in writing or via email to geral@thetripidea.com, before the start of the trip.
The Client is obliged to purchase personal travel insurance, which may or may not be purchased through the Agency. The insurance must be adjusted to the duration of the trip, destination and type of activities. By not subscribing to the adequate travel insurance, the Client automatically exempts the Agency and all its service provider partners from any liability relating to the risks and consequent costs incurred by the Client for not having carried out the protection recommended to him/her.Additionally, when registering for the trip, the Client must provide proof of the travel insurance contract/policy contracted via email.
For each trip, the Client must have the following documents:
Documents such as Personal Certificates and the like are not considered valid for travel. Citizens of countries other than Portugal must obtain all information about all the conditions and requirements necessary to access Colombia from legal entities.
It is the traveller's responsibility to organise all personal or family documentation, and all documents must be within the required validity periods.
The Agency is not responsible for the refusal or granting of visas or even for the non-authorization of the Client to enter a foreign country and/or to Colombia. Any and all costs that this situation may entail will be the sole responsibility of the Client.
If the Customer has a complaint regarding their travel experience, they must inform the leader of the trip during the course of the same and, if the matter is not resolved after his/her best efforts, their complaint must be made in writing to the Agency or via email to geral@thetripidea.com, in the specific section for this purpose, as soon as reasonably possible, within a maximum period of 15 days after the trip has ended, so that the complaint can be analysed.
If the Client fails to do so within 15 days, its rights under this complaint may be affected. Any dispute arising from this service provision contract will be settled by the Ministério de Industria, Comercio y Turismo MINCIT of Colombia.
All prices indicated on the website, social networks and/or Agency documents already reflect the Value Added Tax VAT at the current rate.
The respective exchange, airport, security and fuel rates are included in the final price shown in each travel program. However, there is always the possibility of some change between the date of completion of the program and the date of completion of the trip, so the respective rates are subject to change until the date of the start of the trip.
Under the terms of the legislation in force, the liability of the Agency for the trips included in this program and arising from the obligations assumed, is guaranteed by civil liability insurance from the company Seguros Generales Suramericana SA, policy number 900000926785 amounting 470’000.000 Colombian pesos.
